General terms and conditions IMAGE OF THE CITY

Art. 1 Applicablity

These general terms and conditions are applicable to the offer of IMAGE OF THE CITY and to all online purchase agreements.
The consumer will agree with these general terms and conditions before confirmation of the agreement. Therefore, the consumer will accept these general terms and conditions when placing an order.
If any of the aspects of these general terms and conditions are not clear, these should be explained ‘in the spirit of’ these general terms and conditions.

Art. 2 The offer and the product price

We try to be as accurate as possible to describe our products, so that the consumer can make a proper judgement of the offer. This means in particular clarity about:
- the prices incl. VAT
- delivery costs
- returning / right of withdrawal
- payment , delivery

The images used on the website are a true representation of the products offered. All drawings, specifications information in the offer are indicative and may not lead to damages or rescission of the contract. IMAGE OF THE CITY can not guarantee that the colors displayed completely correspond with the real colors of the products. The supply of products or services mentioned prices include VAT.

All prices are subject to misprints. For the consequences of misprints no liability is accepted. At misprints is IMAGE OF THE CITY no obligation to provide the product of the incorrect price.
During the period mentioned in the offer, prices of the products and / or services will net be increased, except in the case of changes in tax rates.

Art. 3 The agreement

The agreement is established when the consumer accepts the offer and accepts the corresponding conditions.
Once the consumer has accepted the offer, IMAGE OF THE CITY will confirm the receipt of the acceptance of the offer. by e-mail Until receipt of this acceptance not IMAGE OF THE CITY is confirmed, the consumer may rescind the contract.

IMAGE OF THE CITY gives the consumer the following information:
- the address of the CITY IMAGE or where the consumer can lodge complaints;
- the conditions under which and the manner in which the right of withdrawal consumer can be exercised, or a clear statement regarding the exclusion of the right of withdrawal;
- information about guarantees and after sales service;

Art. 4 Execution of the contract and delivery of products

IMAGE OF THE CITY will take the greatest possible care when receiving and implementing orders for products.
The place of delivery is the address that the consumer has indicated to IMAGE OF THE CITY.
The displayed delivery times are indicative on the website. Consumers cannot derive rights from those periods. If a delivery term is exceeded, the consumer is not entitled to compensation.

IMAGE OF THE CITY shall carry out the delivery of the order as soon as possible, but at least within 30 days, unless consumer has agreed with a longer delivery term.
If delivery is delayed or if an order is not or only partially carried out, the consumer receives information no later than 30 days after placing the order. In this case, the consumer has the right to terminate the agreement without penalty. The consumer is not entitled to compensation.
In case of termination on this basis, IMAGE OF THE CITY will repay the amount paid by the consumer as soon as possible, but at least within 14 days after termination.

The risk of damage and/or loss of products rests with the IMAGE OF THE CITY until the moment of delivery to the consumer or to a representative that was announced to IMAGE OF THE CITY beforehand, unless otherwise agreed.

Art. 5 Right of withdrawal and return of products

When purchasing products, the consumer can terminate the contract without giving any reason within 14 days. This period starts on the day following receipt of the product by the consumer or by a representative that was announced to IMAGE OF THE CITY beforehand.

During this 14-day period, the consumer will treat the product and packaging carefully. He/she will unpack the product only to the extent necessary to assess whether he/she wishes to keep the product. If he/she exercises his right of withdrawal, he/she will return the product with all accessories to IMAGE OF THE CITY, if reasonably possible in its original condition and packaging. IMAGE OF THE CITY may provide additional instructions.

When the consumer wishes to exercise his right of withdrawal, he is required to indicate this to IMAGE OF THE CITY within 14 days after receipt of the product. Once the consumer has expressed the wish to make use of his right of withdrawal, he/she should return the product within 14 days. The consumer must prove that the goods are returned on time, for example through a proof of posting. If the customer does not keep sight of these two periods, the sale is a fact.

If the consumer exercises his right of withdrawal, the cost of returning the goods are at his / her account.

IMAGE OF THE CITY will refund the amount paid by the customer as soon as possible but no later than 14 days after cancellation. Condition is that the product has already been received back by IMAGE OF THE CITY or that the customer can produce conclusive evidence of complete return.
